Service Terms and Booking Information
1. Order
Please arrange the date, time, and type of photography or videography through:
– Phone: +420 722 710 887
– Email: fajmonovaz@gmail.com
A reservation is valid only after it has been mutually confirmed by both parties.
By confirming the booking (via email or another demonstrable method), the client expressly agrees to these Terms and Conditions, which form an integral part of the contract for the provision of photographic and/or videography services.
We also recommend that you read the Privacy Policy, which is available upon request or online.
2. Payment Terms
Booking and Deposit
To confirm a booking for a commercial photography session, a non-refundable deposit of 30% of the total service fee is required, unless otherwise agreed in writing by both parties. The deposit is payable based on a pro forma invoice and must be received in advance. The booking is considered valid only once the deposit has been credited to the service provider’s bank account.
Final Payment
The remaining balance is due within 7 calendar days following the completion of the photo session, based on the final invoice. In the event of late payment, the service provider reserves the right to charge interest at a rate of 0.05% of the outstanding amount per day of delay.
Cancellation Policy
If the Client cancels the booking after the deposit is paid but before the wedding, the deposit is non-refundable. If cancellation occurs within 30 days of the wedding, the Client agrees to pay 70% of the total agreed fee as compensation for lost earnings.
In the event that the photography services cannot be performed due to force majeure (such as illness, accident, natural disaster, etc.) on the part of the Photographer, and if such circumstances are beyond dispute, the Client agrees to accept a replacement photographer of equal or higher professional level. If force majeure prevents the event from taking place on the Client’s side, the Client agrees to compen
sate the Photographer for 50% of the total agreed fee as lost earnings. Force majeure, for the purposes of this Agreement, shall be interpreted in accordance with Section
2913 of Act No. 89/2012 Coll., the Civil Code of the Czech Republic, which provides for unforeseeable and insurmountable events preventing the performance of contractual obligations, and which are ex
ternal to the parties
Payment Details
Payments are to be made by bank transfer to the account of the service provider. Payment details will be provided on the issued invoice.
3. Licensing Terms and Commercial Use
All photographs and video recordings created based on the order are intended exclusively for the purposes specified in the contract or order. Any commercial, marketing, or editorial use of the deliverables (e.g., publication on social media, in media outlets, advertising campaigns, third-party websites, internal or public presentations, resale to third parties, etc.) must be contractually regulated in advance by a licensing agreement.
Without a concluded licensing agreement, the client is not authorized to distribute, sell, or otherwise modify the photographs or videos.
Copyright
Copyrights to all photographic and audiovisual outputs remain fully with their creator — the photographer or videographer.
The client obtains a time- and purpose-limited license for use, the scope of which is defined in the contract.
The photographer/videographer is entitled, with the client’s prior written consent, to use the resulting photographs and videos for their own promotion purposes (e.g., web portfolio, professional articles, competitions, exhibitions, promotional materials, social media, etc.), unless otherwise agreed in the contract.
Data Archiving
Final photographs and video recordings are stored (backed up) by the provider for a period of 30 calendar days from the date of delivery of the order.
4. Editing and Retouching
Editing and Retouching
Photo retouching and video post-production are an essential part of every professional commission. Each wedding is approached individually and reflects the artistic vision of the photographer or videographer – which is precisely why the client chooses them.
RAW files and unedited photographs or vides
All photographs and video footage are delivered to the client in a final edited form and in standard formats suitable for common use (e.g., JPEG, MP4). Unedited original files (so-called RAW formats) are not included in the final delivery and will not be provided
Photographic Deliverables:
Photo retouching includes basic skin corrections, color adjustments, removal of unwanted objects or blemishes, and other enhancements deemed appropriate by the photographer.
Video Deliverables:
Basic video editing includes:
– cutting and editing
– color grading
– selection and application of music from a licensed audio library (exclusively royalty-free tracks)
– synchronization with voice-over or subtitles (if part of the agreed project scope)
More advanced edits (such as VFX, animation, motion graphics, or mastering for different output formats) are charged separately based on the specific requirements of the project.
5. Delivery of Final Photographs/Video
Delivery of Photographs and Videos
Final edited photographs and/or video will be delivered to the client only after full payment for the agreed services has been received.
Standard Delivery Time
The standard delivery time for final edited photographs or videos is 10 to 12 weeks from the date of the photo/video shoot, depending on the scope of the project and the photographer’s current workload.
In exceptional cases (e.g. illness, technical issues, or operational complications), the delivery time may be extended. The client will be informed of such circumstances without undue delay.
Delivery Method
Final photographs or videos are delivered electronically via a secure download link (e.g. Uschovna.cz, WeTransfer, or another agreed platform).
If preferred, personal delivery of the final files can be arranged by mutual agreement.
Selection of Images/Footage for Editing
The selection of photos or video footage for editing is carried out exclusively by the photographer or videographer (unless otherwise agreed in advance).
Photo and video editing is performed in accordance with the photographer’s or videographer’s unique creative style, which is the reason for the client’s choice of services.
According to Czech Copyright Act No. 121/2000 Coll., it is strictly prohibited to further edit or use the final photographs or video without the written consent of the author.
The final selection of images or footage is not subject to later changes based on client preferences, unless such adjustments were agreed upon prior to the booking of services.
